The regular Planning and Zoning Board meeting was called to order at 6:10 p.m. on April 7, 1999 by Chairman Eddie Phillips in Town Hall Chambers. He led the Pledge of Allegiance to the Flag.

OLD BUSINESS:
I. APPROVAL OF THE MINUTES OF THE MARCH 3, 1999 P & Z MEETING
NEW BUSINESS
I. A REQUEST BY MR. DON BROWN to widen his dock by 6 ft.; to ramp down to his dock eliminating steps; and to add 16 ft. to the length of his dock at 907 Sunset Bay Court on Garniers Bayou - Mr.Brown just recently bought the home and found out that his boat is 6 inches wider than the boat slip and also longer. Therefore he wants to extend the dock on both sides to get to his boat and be able to wash it on both sides. Most of the deck is over land. Right now it is just a messy area with pilings sticking up in the air. The steps going down to the walkway are dangerous especially at sunset, because they are hard to see, and for safety reasons he will put in a ramp. There is a variance going with the land right now that needs to be extended by the 16 ft. The extension has to be recorded with the new date. The project is done by Decks'N Such. Documents such as the letter from DEP and Army Corps of Engineers should be here before this item goes to Town Commission. Mrs. Wilkinson said she would call Decks'N Such to see where the paperwork is. Patti Culjak moved to send the request to Town Commission if the necessary documents will be brought forth. It was seconded by Ursel Behnken. Mrs Wilkinson said recommendation with a contingency that no permit be issued from the Town until the DEP and Corps letters are received has been an acceptable procedure. The motion passed unanimously. II. MRS. DIANE SULLIVAN, 868 MANDE COURT - Mrs. Sullivan was concerned about the storm drainage project involving her home; the fence, the concrete next to the home etc. Mrs. Wilkinson said when the Sullivans bought their home, the fence was already there, but CMSGT. Sullivan built a dog run in the easement which was not permitted, and he was told that if work had to be done in the easement he was responsible for it. Mrs. Sullivan said that her husband is TDY now and she could have gone on vacation if it weren't for the uncertainty about the drainage problem. She said if I had gone and then come back and everything was gone, dogs included, she would have been very upset. She feels she should have been notified of the time frame of the construction. She also questioned why the pipes cannot go the way they were originally intended to go - that is past Cliff Meigs' house. Mrs. Wilkinson had offered Mrs. Sullivan that the Town's maintenance man could remove the fence for her and put it back if it is still in good enough condition. And the contractor could remove the concrete but he could not put it back. Mrs. Sullivan said the fence should be put back even if it was not in good condition. Mrs. Wilkinson said because of unforeseen problems such as a broken gas line and a broken waterline, the time schedule was made more complicated. Patty Culjak said that the Town did a lot of work at Garniers Cay and it all was put back. Mrs. Wilkinson explained that it was to be put back - that here the residents granted the Town an easement on common property if the Town was responsible and would put it back to its original state as closely as possible. Mrs. Culjak also inquired about the monies expended for the contract and whether there was anything left over. Mrs. Wilkinson explained that the CDBG contract falls under certain guidelines. The contractor is paid on documentation, based on materials and labor agreed upon beforehand ( by contract), recommendation for payment by the Town's engineer, and approval by the Town Commission and the Grant administrator. Mr. Phillips said that the contract was very structured, and contingencies like the fence for the Sullivans are not allowed. Any assistance with the fence for the Sullivan family must come from the goodness of the hearts of the Town Commission. Normally the property owner is responsible. Patty Culjak moved to recommend to the Town Commission that if the fence looks like it is in excellent condition, and Jeff can restore it to its original condition, there is nothing necessary for the Town to do. If it does not look as in good condition afterwards as it is now, then I would recommend that the Town Commission look first to the grant money to see what is available to perhaps get it done and then secondarily for the Town to replace the fence or at least the portion of the fence that needs to come down - in the interest of taking care of the resident. It was seconded by Jimmy Jones and passed unanimously. ADMIN OFFICIAL'S REPORT I. CONSTRUCTION REPORT - as attached Jimmie Jones asked what was considered pervious material for decks. Mrs. Wilkinson said that deck boards as long as they are spaced, gravel and some of the dolomite depending on its composition and the grade of the stone. II. T-SQUARE - The contractor, Lord & Son, was issued a certificate of zoning compliance today. III. NEW STATE LAW - A new state law for the construction industry is going to be approved by the legislature. The building codes will now be by state law instead of the southern Building Code.ADJOURNMENT: Jimmy Jones moved to adjourn the meeting at 7:10 p.m. It was seconded by Ursel Behnken and passed unanimously.
