SHALIMAR TOWN COMMISSION MEETING

DECEMBER 14, 1999

Mayor Gary Combs called the regular Shalimar Town Commission meeting to order at 6 p.m. on December 14, 1999 at Town Hall Chambers and led the Pledge of Allegiance to the Flag.

ROLL CALL FOR THE RECORD:

Others attending were Rudy Sutton, Nell Webb, Connie Gluvna, Attorney Mike Chesser, Ursel Behnken, Police Chief John Blackburn, Theresa Norris, representing BCM Engineers, Rick Burnham, Officer Pat Simon, Mack Kirkland, Wylene Sutton, and Bill and Nancy Frey.

P & Z RECOMMENDATIONS:

I. VARIANCE ON THE FREY PROPERTY – The property is located on Lot 4, Block A, Palm Shore Subdivision. Mr. and Mrs. Frey were present. Comm. Callen moved to approve the variance in accordance with the P & Z findings. It was seconded by Comm. Tucker and passed unanimously.

OLD BUSINESS:

I. APPROVAL OF MINUTES OF THE NOV. 9, 1999 TOWN COMMISSION MEETING – Changes had to be made on Page 3 – Mayor’s Report, because the Mayor was out of town and not at the meeting. Items I, II, III and IV became II, III, IV and V. Comm. Callen moved to approve the minutes as changed. It was seconded by Comm. Henderson and passed unanimously.

II. STATUS OF LAW SUITS – Mr. Chesser said that he received a copy of the brief Mr. Petermann sent to the Court. He is the attorney for Racetrac. The Judge has made no order in the case yet. Racetrac still wants the same things as before. The other case (penalty for violations) has not gone to court yet.

III. STATUS OF CDBG STORM WATER MANAGEMENT GRANT – Theresa Norris of BCM Engineers said that everything is now completed. The sodding has been done but it still needs some adjustment on the pump for the pond. Comm. Tucker requested to know what the cost of running the pump is. Rudy Sutton said that the pump is on a timer and it does not have to run all the time.

IV. STATUS OF PARK GRANTS – See attached memo from Rudy Sutton. Handicapped parking (one space only) will be along Shalimar Drive. The walkway from the water to the road including the parking area will be pavers. The work cannot be started until DEP sends the dock permit.

V. TOWN HALL RENOVATION – Mr. Sutton said that the Police office’s floor is done now and it looks great. The heater broke and Andrew Electric gave an estimate of $250 for fixing it with a one year warranty. If the unit has to be replaced, Andrews will use the $250 toward a new unit. For right now space heaters will be used, but several other estimates should be sought. For a heat pump the price would be around $3,500.

NEW BUSINESS:

I. OWN RESIDENTS’ TIME – None needed.

II. SIGN ENFORCEMENT; SPIFFY LUBE AND OTHERS – The Mayor has observed that Fred’s Showcase puts out banners and across the street Jiffy Lube puts out flags. Each company received the new ordinance; the Chief has spoken to them also. Next time anything is put up that is not allowed by the ordinance, the Mayor wants to levy a $500 fine. They have 10 days to take action. The notification will go certified mail. To be consistent, this will be done to any business violating the ordinance. Mr. Chesser suggested to take pictures of the violation for proof.

III. RESPONSE TO PALM SHORES ASSOCIATION LETTER – The Mayor said that the Commission took care of the letter by allowing signs being posted at the entrance of the subdivision. The homeowners are happy with it. Comm. Callen said that the Neighborhood Watch Area issue needs to be substantiated, maybe by planning a meeting with the Homeowners Association. The Mayor asked Comm. Henderson to write a letter to the Association and ask for a point of contact.

MAYOR’S REPORT:

I. WEB SITE UPDATE – The Shalimar Yacht Basin information is available on Web site. They are listed with us because they have an occupational license.

II. POSITIVE ATTITUDE/ RUMOR CONTROL – The Mayor said that if employees had nothing positive to say, to say nothing. If they hear any rumor it should be corrected, and otherwise to be very positive.

III. EMPLOYEE OF THE QUARTER – The Mayor recommended Mr. Rudy Sutton as Employee of the Quarter. He would like to treat Mr. Sutton for dinner in the second week of January to recognize him. Mr. Sutton wants to retire, but the Mayor does not want to lose him and wants him to change his mind. Attorney Chesser said that Mr. Sutton has the corporate memory and it would be very helpful to download that.

IV. EMPLOYEE APPRECIATION DAY – The Mayor is asking for an Employee Appreciation Day for all. The Maintenance and Police departments would be on call. This would be a personal day off before the New Year. Comm. Henderson moved to give all full time employees one day off in December with pay, which should be worked out with each employees supervisor. It was seconded by Comm. Callen and passed unanimously.

COMM. TUCKER’S REPORT:

I. FINANCIAL REPORT – The financial report is updated every month, same with line item changes. She said she cannot make giant changes but stay within reason. Comm. Tucker suggested to pay a little more on some items. She said that if we buy quality items the Town might save in the long run.

II. POLICY MANUAL – Comm. Tucker had misplaced the policy manual, and just found it. She is still working on it.

III. CHRISTMAS BONUS – She said the Christmas bonuses had already been agreed upon and will be written this week..

IV. AUDIT – Results of the audit will be preliminary by the end of this month. The Town paid off the loan for the land last week.

V. BANK MOVE – The Town moved its banking to AmSouth Bank from Nations Bank. Comm. Tucker and Nell Webb had a meeting with Mr. Wainwright at AmSouth Bank and were very pleased with the lower amount of fees.

COMM. BROWN’S REPORT:

I. CHRISTMAS PARTY UPDATE – Comm. Brown announced the annual Christmas Party will be held on Dec. 19 from 2 to 4 p.m. He said Santa will be here, he contacted the usual food donors. Mrs. Webb bought Christmas gifts for the children at WalMart. Everything seems to be lined up.

II. TIME CAPSU8LE UPDATE – Comm. Brown said he is open for suggestions as to what to put into the time capsule. Somebody mentioned to put in a video of the Town, but in 100 years, probably nobody knows what a video is. He would like to put in the Town’s road map and history, printed in 1994 and pictures of the area.

III. MILLENIUM CELEBRATION – Comm. Brown said the usual things, like a parade, a bazaar, a fireworks display, are already planned. The Mayor will represent the Town.

COMM. CALLEN’S REPORT:

I. COMMUNICATION FROM PALM SHORES HOMEOWNERS – Comm. Callen received another letter on the drainpipe in the Palm Shores area. This time the issue is the rust in the drainpipe and its safety aspect.

COMM. HENDERSON’S REPORT:

I. NEIGHBORHOOD WATCH AREA SIGNS – Comm. Henderson was asked to write letters to those Homeowner Associations that do have Neighborhood Watch Area signs. He was asked to touch base with them and find out who their point of contact is.

II. NO WAKE ZONE – He sent a letter to the general manager of Shalimar Yacht Basin and Como Marine asking them to support the Town financially with the No Wake Zone issue. Rick Burnham of Shalimar Yacht Basin read a letter outlining their opposition. The Mayor said he received a letter from Mr. Myron Tassin of 244 Snug Harbour and has spoken to residents in the immediate area who feel that the many boats coming and going from the Marina are a safety hazard. A new ordinance has not been advertised. The Mayor said he would like to advertise the ordinance, invite the residents and do it right. Comm. Henderson said the ordinance is written he just needed the coordinates from Myron Tassin’s house to Winjum’s home on Gardner Drive. The file is open at State till January 28, said Comm. Henderson. Comm. Tucker moved to have the first reading of the "No Wake Zone" Ordinance on January 11, 2000 and to invite the residents to the meeting to hear their comments. It was seconded by Comm. Henderson. The motion did not pass. (Two yeahs – Tucker and Henderson; three no’s – Combs, Callen and Brown). Comm. Callen said that some discussion on this was held about two years ago. Residents on Shalimar Drive, Palm Shores and Sara Drive also would like to be included in the No Wake Zone issue. Comm. Henderson was asked to write a letter and ask for more policing and enforcement.

III. REVIEW OF ORDINANCE 2000-03 CURFEW – The title of Ordinance 2000-03 was read. The curfew hours still need to be changed from12:01 a.m. to 11:01 p.m. for youths younger than 18. Comm. Henderson moved to adopt Ordinance 2000-03 as read with the above mentioned changes. It was seconded by Comm. Tucker and passed unanimously.

POLICE CHIEF’S REPORT: AS ATTACHED

The Mayor gave Chief Blackburn a letter for a grant. Mr. Sutton contacted Tallahassee and received the grant package back. He thinks it should not be too difficult to finish the paperwork and Mayor Combs said he would make a special trip to sign the paperwork. Deadline is Dec. 15 at midnight. Chief said that finally the sidewalk for the school children is being built adjacent to North Eglin Parkway.

ANNOUNCEMENTS:

DEC. 16 – OCLOC QUARTERLY WINTER DINNER IN CRESTVIEW

DEC. 19 – TOWN CHRISTMAS PARTY FROM 2 – 4 P.M. – Mayor would like for Santa to be escorted through Town in a car. Connie said she has a friend with a red BMW convertible.

DEC. 29 – P & Z MEETING – 6:30 P.M.
