SHALIMAR PLANNING AND ZONING BOARD

REGULAR MEETING – May 30, 2001

The regular meeting of the Shalimar Planning and Zoning Board was called to order by Chairman Eddie Phillips on Wednesday, May 30, 2001 in the new Town Hall chambers at 6:30 p.m. He also led the Pledge of Allegiance to the Flag.

ROLL CALL FOR THE RECORD:
Chairman Eddie Phillips – present
Co-Chair Roy Pimental – present
Secretary Ursel Behnken – present
Member Jimmy Jones – present
Member Rick Larsen – present

Others present were Town Clerk Tom Burns, Brent Acree, Mark Pittman and Darrin and April Habel.

OLD BUSINESS:
I. APPROVAL OF THE MINUTES OF THE MARCH 28, 2001 MEETING - Jimmy Jones moved to approve the minutes of the March 28, 2001 meeting. It was seconded by Rick Larsen and passed unanimously.

NEW BUSINESS:
I. 18 SHALIMAR DRIVE – SETBACK VARIANCE –
Mr. and Mrs. Habel as well as their contractor Brent Acree were present. He said that when he bought the property, he had the impression that the lot was 75 feet wide and had a house designed accordingly. Then he noticed that the lot was only 70 feet wide and he needed a variance to build his house. His father who has the lot next to him on the west side, has no objections to giving his son 28 inches. They will still have 14 feet between the two homes. The houses behind them have only 10 feet between them because they are a PUD. Jimmy Jones moved to grant the variance to the Habels. It was seconded by Roy Pimental and passed unanimously. Town Clerk Burns was advised to write a letter outlining the stipulations of the variance.

II. Mark Pittman – 20 Shalimar Drive – Mr. Pittman who has lived at that location for quite some time, said when the subdivison (Brande/Mande Roads) were built behind him, his a nd his neighbors houses became the drainage for the whole area. He cannot put anything in the garage, the water just flows through it. A normal rain is not so bad, but since the lake was put in the water seeks the fastest way to it.A suggestion was made to put a swale in behind the homes to direct the water away from the homes. Eddie Phillips suggested to build a swale behind the homes along the fences, line it with plastic and gravel. He asked Mr. Pittman to study that possibility and come back to the board with a recommendation. He said maybe the 1-cent tax for capital improvement will pass, which would help greatly.
