Planning and Zoning Minutes

October 29, 2003


The regular meeting of the Shalimar Planning and Zoning Board was called to order by Chairman Jimmy Jones on Wednesday, October 29, 2003 in Town Hall chambers at 6:00 p.m.   Jimmy Jones led the Pledge of Allegiance to the Flag.

Others present were Town Manager Tom Burns, Doug Walkinshaw ( 2563 Palm Shores Drive ), Pat McLain ( 6 Gardner Drive ).

 

OLD BUSINESS:

APPROVE MINUTES OF THE SEPTEMBER, 2002 MEETING – Gene Tucker moved to approve the minutes of the September 24, 2003 meeting as written.  The motion was seconded by Sandra Dove-McLain and passed unanimously.

         

NEW BUSINESS:

I.

 

Setback Variance Request for 2563 Palm Shores Drive - The board reviewed the request for the setback variance at 2563 Palm Shores Drive .  Mr. Walkinshaw (owner of said property) noted that he would like to put in a deck from behind the garage to the pool area.  Chairman Jones mentioned that the decking area may put Mr. Walkinshaw's impervious suface close to 50%.  Town Manager Burns checked the numbers for the above mentioned property and concluded that Mr. Walkinshaw was within the limits of the impervious surface of the property.  Town Manager Burns made Mr. Walkinshaw aware that he would need to have some way to pump out the ground water at the location of the pool area, as not to pump the ground water out into the road.  Chairman Jones stated that Mr. Walkinshaw could use pavers, rocks, etc. for his yard, but he could not put down any more concrete on the property.  Mr. Walkinshaw stated that the property was already completely fenced for the pool. 

Town Manager Burns wrote to all of the neighbors concerning the variance.  He did not receive a response from the surrounding homeowners.  Mr. Walkinshaw spoke to the Homeowners Association about the variance, they concluded that putting in the pool on his property was fine, but he would need to get a waiver from the adjacent Shalimar Plantation Homeowners Association for the concrete truck.  The waiver is for concerns that the concrete truck might deteriorate their streets.  Mr. Walkinshaw is now only waiting on the above mentioned waiver (secured by the construction company.  Gene Tucker moved that the Planning and Zoning Board approve the pool design as presented and allow a minimum of 5 feet from the home structure and the side and rear property lines.  Sandra Dove-McLain seconded the motion and it passed unanimously.
