ORDINANCE 97-05

AN ORDINANCE PROHIBITING DUMPING AND DEPOSITING MATERIAL IN DRAINAGE DITCHES, EASEMENTS AND RETENTION BASINS IN THE TOWN OF SHALIMAR, FLORDIA.

WHEREAS, the Town of Shalimar has previously adopted an ordinance

Prohibiting the throwing of litter and other materials on streets, sidewalks and other public places; and

WHEREAS, the Town of Shalimar wants to prohibit littering or dumping of garbage, refuse or other materials within its drainage ditches, easements and retention basins.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN OF SHALIMAR, FLORIDA:

Section 1. That the Code of Ordinances, Town of Shalimar, Florida, is hereby amended by adding a section to be numbered 26-35 which section reads as follows:

“Section 26-35 Littering drainage ditches, draining easements and retention basins.

No person shall throw or place any refuse, paper, trash, glass, nails, tacks, wire, bottles, cans, grass clippings, brush, yard trash, concrete, earthen fill, garbage, containers, or litter or other debris in any ditch, drainage easement or retention basin that regularly or periodically carries surface water runoff. Any person who deposits any of the above shall remove it or shall cause it to be removed there from immediately”.

Section 2. A violation of the foregoing shall be punished as provided for in Chapter 1. General Provisions, Sec 1-14 of the Code of Shalimar, Florida.

Section 3. In the event that the Town of Shalimar deems it necessary to bring civil action to enforce the terms of this Ordinance, the violator shall be responsible for all court costs and attorney fees incurred by the Town.
