ORDINANCE NUMBER 2006-03

 

AN ORDINANCE MODIFYING THE SHALIMAR CODE PERTAINING TO MARINAS AND TRANSIENT VESSELS

 

 

Whereas,   The Town of Shalimar has recently changed the zoning classification of the last parcel zoned “Industrial” to a classification of “Planned Development Project”; and

 

Whereas,   The Town of Shalimar is largely developed with residential and commercial buildings such that it is now possible to more accurately assess the effect of permanent moorage of vessels in a marina within the Town of Shalimar; and

 

Whereas,   The Town of Shalimar desires to maintain the water quality in Garnier’s Bayou; and

 

Whereas,   There are now boats of various sizes which require attention of the Town Police Department, Town expenditure for roads, and other municipal services, and the town desires to remove certain restrictions on persons residing on boats; and

 

Whereas,   All information found in Section 82-223 is replicated in Shalimar Code of Ordinances, Section 62-77.

 

 

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN OF SHALIMAR , FLORIDA :

That the Code of Ordinances, Town of Shalimar , Florida , is hereby amended as follows:

 

Sec. 54-1.  Definitions

Add:

Marina shall mean any facility having ten or more slips or moorage spaces (inclusive) for vessels.

 

Add:

Transient Vessels shall mean vessels which are moored at a marina in Shalimar for less than 30 days within any 60 consecutive days.

 

Sec. 62-63.  Living on Boats

Sec. 82-223.  Marinas ; docks.

Current:

All commercial marinas shall be subject to annual permitting and inspection by the town. The following procedures shall be applicable:

(1) Persons desiring to construct a new dock or add to, alter, remodel, or reconstruct an existing dock shall apply for and obtain a permit and other authorization from the town and the county prior to construction.

 

(2) Permits for docks, marinas are not transferable without the written consent of the town.

 

(3) The permittee shall be responsible for the condition and repair of permitted docks. Failure to maintain the docks in a safe condition shall constitute grounds for revocation of the permit.

 

Change to read:

 

Requirements for Marinas

(1)     All marinas must maintain equipment and dedicated space capable of hauling out of the water and removal by vehicle of any vessel slipped or moored in the marina, except transient vessels.

(2)     All marinas must maintain equipment capable of pumping out all fluid waste stored on vessels, moored within the marina.
