AN ORDINANCE OF THE TOWN OF SHALIMAR RELATING TO
ANNEXATION OF CONTIGUOUS PROPERTY TO THE TOWN; PROVIDING FOR AUTHORITY;
PROVIDING FOR LEGAL DESCRIPTION; PROVIDING FOR MAP OF ANNEXED AREA; PROVIDING
FOR ZONING AND LAND USE MAPS REVISED; PROVIDING FOR ZONING AND LAND USE;
PROVIDING FOR COMPLIANCE WITH LAW; AND PROVIDING FOR AN EFFECTIVE DATE
Whereas,
the subject property, Lots 1, 2, 3, and 4, Block 101, Port
Dixie Subdivision, Section 5, Township
2 South, Range 23 West, as recorded in Plat Book 1, at Page 64, Records of
Okaloosa County, Florida;
Whereas,
the Town Commission has received a Petition signed by the
owner of the property to be annexed.
Such Petition is attached hereto and marked as Exhibit "A" and
incorporated by reference; and
Whereas,
the
conditions precedent to annexation of property into the Town has
been fulfilled; and
Whereas,
annexation
of the property and an amendment of the Land Use maps are consistent
with the best interests of health, safety and general welfare of the
Town of Shalimar.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF
THE TOWN OF SHALIMAR, FLORIDA, AS
FOLLOWS:
SECTION
1. AUTHORITY. The authority for
enactment of this Ordinance is Section 166.021, Florida Statutes and Section
171.044, Florida Statutes.
SECTION
2. LEGAL DESCRIPTION. Lots 1, 2,
3, and 4, Block 101, Port Dixie is situated
in Okaloosa County, Florida and contiguous to the Town of Shalimar, Florida
and is hereby annexed to the Town and the Town's boundary lines which shall
hereby be amended to include named property within its Town limits.
SECTION
3. MAP OF ANNEXED AREA. The
property to be annexed to the Town of Shalimar is specifically set forth in
the map which is attached hereto and marked as Exhibit "B" and
incorporated by reference.
SECTION
4. ZONING AND LAND USE MAPS REVISED. All
Town base, zoning and land use maps and any other applicable maps of the Town
shall be revised and amended to incorporate that property annexed to the Town,
which is described in Exhibit "A" attached hereto and made a part
hereof, concurrent with the effective date of this Ordinance.
SECTION
5. ZONING AND LAND USE. Pursuant to
general law, the property annexed to the Town, was subject to Okaloosa County land use plan, zoning and subdivision
regulations which shall remain in full force and effect until rezoned by
the Town to comply with the comprehensive plan.
SECTION
6. The Town of Shalimar does hereby certify that the property to be annexed
complies with the requirements of Fla. Stat. Section 171.0413, including
specifically a finding that the property is contiguous and compact, that
municipal services may reasonably be provided to the property, and that the
owner has petitioned the Town for Annexation into the Town of Shalimar.
SECTION
7. COMPLIANCE WITH LAW. The Property
annexed to the Town, which is described in Exhibit "A" attached hereto
and made a part hereof, shall be subject to all of the laws, ordinances, and
regulations in effect in the Town upon the effective date of this Ordinance.
SECTION
8. EFFECTIVE DATE. This Ordinance
shall become effective upon its adoption by the Town Commission and signature of
the Mayor.
